Terms of Service & Refund Policy

1. Agreement to Terms

By requesting a quote, approving a design proof, or submitting a payment to MizMosaics, you explicitly agree to be bound by these Terms of Service. These terms constitute a legally binding B2B agreement between you (the Client) and MizMosaics regarding the custom manufacturing and delivery of glass art products.

2. Custom Order Nature & Design Approval

All MizMosaics products are 100% bespoke and custom-made to order. We do not hold inventory of pre-made items. Every piece is manufactured specifically based on the dimensions, figures, and color palettes approved by you.

• The payment of the initial deposit serves as your official digital signature and final approval of the design proof.
• Once production begins, dimensional or design alterations cannot be accommodated without incurring additional fees and timeline extensions.

3. Payment Terms & Schedule

To ensure continuous production capabilities and secure materials, our payment structure is strictly enforced:

• Initial Deposit: A non-refundable 50% deposit is required to initiate the artisan production process.
• Final Balance: The remaining 50% balance must be cleared in full prior to the physical release of the product for international shipping.
• All financial transactions are processed securely via Stripe.

4. Strict No-Refund & Cancellation Policy

Due to the irreversible nature of custom glass cutting and assembly, all sales are final. We enforce a strict no-refund policy designed to protect the integrity of our artisan labor.

• Once the 50% deposit is processed, the order enters active production (typically within 24 hours) and cannot be canceled, modified, or refunded under any circumstances.
• Any chargebacks or payment disputes initiated by the Client post-approval will be vigorously contested using this agreement, the approved design proofs, and all related communication logs as evidence of a valid custom transaction.

5. Shipping, Customs, & Lead Times

We leverage a streamlined nearshore supply chain to deliver from Guadalajara, Mexico, directly to your US job site.

• Estimated lead times are provided in good faith during the quoting process.
• While we maintain rigorous logistics standards, delays caused by US border customs inspections, international freight carrier disruptions, or force majeure events are strictly beyond our control.
• Such external delays do not constitute a breach of contract and are not grounds for order cancellation or refunds.

6. Risk of Loss & Transit Damage

We professionally crate and package every mosaic for international transit. However, risk of loss passes to the Client upon our delivery of the goods to the freight carrier.

• The Client must inspect the crate immediately upon arrival. Any transit damage must be reported to MizMosaics within 48 hours of delivery, accompanied by clear photographic evidence of the packaging and the product.
• Failure to report transit damage within this 48-hour window waives the Client's right to claim replacement or insurance coverage.

7. Limitation of Liability

MizMosaics functions exclusively as the product manufacturer. We are not liable for installation failures, structural pool issues, or improper handling by your contractors.

• In no event shall MizMosaics be held liable for any indirect, incidental, punitive, or consequential damages, including but not limited to project delays, lost profits, or labor costs incurred by the Client.
• Our maximum total liability for any claim arising from this agreement shall strictly not exceed the total purchase price paid by the Client for the specific product in dispute.

8. Quality Assurance & Variations

Venetian glass mosaic artistry is a handcrafted process. Minor tonal variations in glass batches, slight organic deviations in hand-cut lines, and inherent material textures are hallmarks of authentic artisan work, not defects. By commissioning our services, the Client acknowledges and accepts these natural characteristics.
